1.TERMS AND CONDITIONS
We are Experience Mull, hereby known as “We”, “Us” and “Ours”, we look forward to leading bespoke wildlife photography workshops for you on the Isle of Mull. These are our Terms and Conditions, please read them carefully as they are the entire Terms of Agreement between Us and the Guest (“You”, Your” and “Yours”) for your workshop. “You” and “your” include the first named person on the booking and/or any persons on whose behalf a booking is made. These Terms & Conditions provide an explanation of the contract that you enter into with us when you book a workshop. It is important that you read these conditions together with the workshops information.
If any part of these conditions is found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity will not affect the other provisions which shall remain in full force and effect.

2. BOOKINGS
Experience Mull only accepts booking requests through in writing/per email. Upon return of your signed booking form AND deposit payment, we will confirm your workshop with us and begin to make all necessary arrangements. Bookings will not be confirmed, nor other arrangements made, before the deposit payment has been received by us. A booking is made once we have sent a written/email confirmation of the booking to you. We reserve the right to refuse bookings at our sole discretion and all Bookings are subject to full compliance with these terms.​

Short Workshops: We accept one / two participants on our short workshops.
​
Package Workshops: For each Expedition Workshop, a minimum of two participants per workshop is required. Each workshop is conditional on us securing the minimum number of bookings required to operate the workshop. Where sufficient numbers cannot be achieved, we reserve the right to cancel or change a scheduled workshop. We will endeavour to make any decision to cancel or significantly change an expedition no less than sixty (60) days prior to the scheduled arrival date of the workshop. If you are offered a new travel date as a result of this, it is your responsibility to advise your travel insurance company of your new travel dates. We are not liable for any loss in failed insurance claims if you fail to do this.

By making a booking, you and/or the first named person on the booking agrees and also on behalf of all persons detailed on the booking, if more than one, that:

he/she/they have read these Terms & Conditions and has the authority to and does agree to be bound by them;

he/she/they consents to our use of information and personal data in accordance with our Privacy Policy and is authorised on behalf of all persons named on the booking to disclose their personal details to us, including where applicable special categories of data (such as information on health conditions or disabilities and dietary requirements);

he/she/they is over 18 years of age and where placing an order for services with age restrictions declares that he/she and all members of the party are of the appropriate age to purchase those services. Persons between the ages of 16 through to 18 are permitted to be booked and travel only with a parent or legal guardian accompanying them. Any person under the age of 16 may not be booked in unless by special request and agreement will be made in advance of the booking at Experience Mull's sole discretion;

he/she/they accepts financial responsibility for payment of the booking on behalf of all persons detailed on the booking.

All workshops prices shown on our website are based on current charges and costs. Costs include but are not limited to: accommodation costs, Mull Charters white-tailed eagle boat trip, Turus Mara Treshnish Isles boat trip, price of fuel, personnel costs, taxes, and other associate costs. These costs are subject to changes outside of our control and may go up or down. We reserve the right to alter the price of any workshop, introduce supplements or correct pricing errors, and will notify you of the current price prior to any booking. The price of your workshop (as shown in your booking confirmation) will not be increased unless you amend your booking. However, we reserve the right not to be legally bound in the case of incorrect pricing and acknowledgement of such an error does not mean acceptance of it.

3. PAYMENT
​
3.1 Short Workshops - Payment Terms:
We require a non-refundable deposit of £75 upon Booking to secure your date(s). The remaining balance must be paid six (6) weeks prior to your workshop date. If a Booking is made within six (6) weeks of the date of arrival, the full invoice amount must be paid within five (5) days of the date of the Booking.

Cancellations: Should you decide to cancel your Short Workshop with us (for any reason), you will forfeit the £75 non-refundable deposit. From four (4) weeks prior to arrival, 50% of the total workshop balance will be due and payable. From two (2) weeks prior to arrival, 75% of the total workshop balance will be due and payable. From one (1) weeks prior to arrival, 100% of the total workshop balance will be due and payable. No refunds will be made in case of late arrival or no show. These terms are to protect our guides and to compensate for lack of earnings that they may otherwise have earned.

3.2 Package Workshop - Payment Terms:
A partially-refundable deposit of fifty percent (50%) of the invoice amount must be received by Experience Mull to confirm your travel arrangements and the remaining fifty percent (50%) must be settled at least sixty (60) days prior to the date of arrival (in accordance with the payment terms below).

If a Booking is made within sixty (60) days of the date of arrival, the full invoice amount must be paid within five (5) days of the date of the Booking.
Cancellations: Cancellations or amendments of Bookings must be received by Experience Mull in writing/per email to be effective. In the event of cancellation or amendment of a Booking after Confirmation, the following policy will apply:

Should you decide to cancel an Expedition Workshop, we will be unable to return a portion of your deposit. This portion equates to £340 (your share of accommodation costs), and £165 (your place on the Mull Charters white- tailed eagle trip). These deposits will have already been paid by us. Therefore, a total of £505 will be retained by Experience Mull upon cancellation UNLESS we can fill the vacancy. IF we fill the vacancy, you will receive your full deposit back.

From confirmation of cancellation up to sixty-one (61) days prior to arrival - £505 (the partially-refundable deposit) will be payable, UNLESS the vacancy is filled.

Thirty one (31) days prior to arrival - 75% of the total workshop balance amount will be due and payable.

Fourteen (14) days or less prior to arrival - 100% of the total workshop balance amount will be due and payable.

No refunds will be made in case of late arrival or no show.

Third-party trips:
On our Expedition Workshops, we organise our boat trips with Mull Charters and/or Turus Mara towards the beginning of the week. If bad weather, or some other reason, causes postponement or cancellation, we will endeavour to re-arrange the trips whilst on your workshop with us. If the trip is postponed or cancelled by the operators (Mull Charters / Turus Mara), and we are unable to re-schedule it whilst you're on Mull, the cost of the boat trip(s) will be refunded to you in full.
Our guides will then substitute the boat trip(s) for additional otter excursions / editing sessions / visits to bird hides, nature walks, etc.

3.3 Other Notes:
Payments
Payments are made via BACS or Paypal if agreed in advance. All payments should be made in GBP (£). If additional charges are incurred (for example, by your bank as a result of currency exchange, or something else) these must be covered by you in full.

Ferries:
In the event of bad weather causing ferry crossings to be cancelled or delayed, please be aware that we cannot postpone the start of the workshop. It is essential you have adequate travel insurance should delayed/cancelled ferries affect your workshop with us.

4. GUEST RESPONSIBILITY
You must follow the Guides or, other reasonable instructions, at all times to ensure: (a) your own safety,
(b) the safety of others on the workshops, and (c) the minimisation of disruption to wildlife. You acknowledge and agree that failure to do so may result in restricted access to wildlife locations on the workshop.

If you have any special dietary requirements / food allergies / other allergies that may cause significant health issues, you must notify us at the time of booking. We provide homemade cakes/bakes/sweet treats on your workshops and will make every effort to accommodate any such requests. However, it is your responsibility to ensure that you actively avoid any food you are allergic to and make all appropriate enquiries to establish the ingredients contained within any food. You agree that we cannot be held responsible should you have any adverse reactions to something you have consumed that we have made.

All our guests are required to conduct themselves in an orderly and acceptable manner and not to disrupt the enjoyment of others on the workshop. If we, or any of our Guides and suppliers, are of the view you are negatively affecting your own health, safety, the environment, wildlife or the enjoyment of other guests on the workshops, we reserve the right to immediately withdraw you from the workshop. This will result in the immediate termination of your booking with us and we will have no further obligations to you and/or your party. No refund or payment of any costs incurred by you will be made by us under these circumstances.

5. HEALTH, FITNESS & MOBILITY
To participate in one of our workshops you need to be fit, agile, and most importantly confident in your balance. We won’t be hiking miles and miles, as much of otter searching involves time in the vehicle, but when we do walk it’ll be across tricky terrain. Some of the tidal flats are rocky, unstable under foot, and extremely slippery. Similarly, the pathways on Lunga (where the puffins are) is completely unmanaged and is steep, rocky, and slippery. Please convey any fitness or mobility concerns to Experience Mull ASAP.

Upon your arrival, if the Guides deem that your mobility is more limited than we were informed, this could result in: (a) a higher chance of causing disturbance to wildlife, and (b) an increased risk of personal injury to you due to lack of balance / agility. As such, the guides may require you to maintain a larger distance away from the wildlife (e.g. observing otters from the road). Please be aware that the photographic opportunities may therefore be limited in this instance.

Please notify us of any injuries / changes / deterioration in your health, mobility in between the time of booking and your attendance on a workshop.
​
Please ensure that you bring any medication you need, the pharmacy and medical services on the island are limited. If, whilst on the workshop, you are in need of medical assistance, there is a GP surgery and a small A&E department on the Isle of Mull. Major incidences often result in medical evacuation via Air Ambulance to larger hospitals in cities such as, Glasgow. Any medical services and costs required during the workshop are at your own expense. We strongly recommend suitable and adequate travel insurance which includes full medical cover.

Unfortunately at this point in time, we are unable to accept wheelchair users due to a lack of vehicle facilities.

6. TRAVEL INSURANCE
You are responsible for ensuring that any existing medical conditions or disabilities which may require assistance are declared to us as early as possible. This is essential for all bookings. Please be aware that during the course of the workshops, we may at times be several hours away from medical assistance.
It is a condition of your booking, and your responsibility, to ensure that you have sufficient and valid travel insurance. Your insurance should cover pre-existing medical conditions, medical expenses, repatriation in the event of accident or illness, cancellation by you for any reason, cancellation charges, etc. If you choose to travel without adequate insurance cover, we will not be liable for any losses no matter how arising, in respect of which insurance cover would otherwise have been available. If you have any questions, these should be raised with your travel insurance provider.

7. WAIVER
By booking onto a workshop with us, you agree that Experience Mull cannot be held responsible for any injuries that may be sustained during a workshop with us on the Isle of Mull, Scotland. Nor can we be held responsible for any damage, loss or theft incurred to photographic equipment and/or any personal belongings, not limited to but including, binoculars, camera bodies, camera lenses, drones etc.

8. GOVERNING LAW AND JURISDICTION
This contract is governed by Scottish law and the jurisdiction of the Scottish courts.
